LazzaStudio AI Usage Notice

Welcome to LazzaStudio. This LazzaStudio AI Usage Notice (this “Notice”) constitutes the additional terms referred to in Section 10.9 of the Shoplazza Terms of Service and applies to your use of LazzaStudio AI features. The provisions of the Terms of Service concerning Shoplazza AI Services, AI Input, AI Output, ownership rights, third-party AI service providers, limitations of AI Output, and measures addressing violations continue to apply. Terms not defined in this Notice have the meanings given to them in the Terms of Service. If this Notice conflicts with the Terms of Service in relation to specific LazzaStudio features, this Notice will prevail. All other matters remain subject to the Terms of Service, the Acceptable Use Policy (“AUP”), the Privacy Policy, and other applicable rules. By clicking “Agree,” “Confirm,” or a similar button, or by using LazzaStudio, you acknowledge that you have read, understood, and agreed to this Notice.

1. Feature Overview

LazzaStudio can generate visual content for e-commerce, including product listing images, images highlighting product selling points, lifestyle and scene images, model images, and posters, based on product images, images of individuals, prompts, product information, or other materials you provide. The available features and supported types of AI Input and AI Output are those displayed on the relevant product pages.

You must ensure that you have the lawful rights to, or have obtained all necessary rights, licenses, permissions, and authorizations for, the materials and information you submit to LazzaStudio, including for their use, upload, processing, and use in generating content. You must not upload personal information, images or likenesses of individuals, trade secrets, or content protected by intellectual property rights that you are not authorized to process, or any other content that is unlawful, violates applicable rules, or is contrary to public order or accepted standards of morality.

2. Images of Individuals and Models

If you use features that generate model images or other images of individuals, you must comply with the following requirements:

(1) You must ensure that you have the lawful rights to, or have obtained all necessary authorizations for, the uploaded images and any likenesses, personal information, or other content contained in them. These rights or authorizations must cover uploading, analyzing, editing, generating, using, and publishing the relevant content, including processing the materials using AI technology and using the generated content for product displays, advertising, and other intended purposes.

(2) If a feature involves generating or editing the face, personal attributes, or pose of an identifiable individual, you must clearly explain the relevant processing to that individual in advance and obtain any authorization or consent required by applicable law. If the processing involves editing biometric information, such as facial information, you must obtain the individual’s separate consent where required by applicable law.

(3) If the materials involve a minor, you must obtain the consent of the minor’s parent or other guardian in advance and comply with applicable requirements protecting minors’ personal information and rights in their images and likenesses.

(4) You must retain appropriate records evidencing the relevant rights, authorizations, or consents. In the event of a complaint, claim, regulatory investigation, or other circumstances in which such evidence is reasonably necessary, you must provide it upon our request.

(5) You must not use these features to impersonate or imitate a specific individual without authorization, or create or fabricate content that may lead the public to believe that a specific individual uses, recommends, endorses, or approves any product or service. You must not use the relevant content for fraud, defamation, insults, sexualized manipulation, false advertising, or any other conduct that infringes the lawful rights or interests of others.

If a model is entirely AI-generated and does not correspond to any identifiable individual, the above requirements to obtain authorization or consent from a specific individual generally do not apply. However, you must not falsely present the virtual model as a real individual, use it to impersonate or allude to a specific individual, or lead the public to believe that a specific individual actually uses, recommends, endorses, or approves any product or service.

To provide the features you select, we may need to perform technical analysis and processing of the product images, images of individuals, prompts, and other materials you upload. Processing images of individuals may involve analyzing features such as their appearance or poses. Unless we expressly inform you otherwise and have a lawful basis for doing so, we will not use these materials to identify a specific individual or verify their identity.

3. Review and Use of AI Output

Due to the limitations of current AI technology, AI Output may be inaccurate, incomplete, unreasonable, visually distorted, contain errors, abnormalities or incorrect product details, or otherwise fail to meet your expectations.

Before saving, downloading, or using AI Output, you must conduct an appropriate human review of its content, product information, depictions of individuals, intellectual property considerations, authorizations to use individuals’ images and likenesses, and other relevant matters.

You must not use AI Output to fabricate or exaggerate a product’s materials, dimensions, functions, performance, effects, intended uses, or other material information, or otherwise mislead consumers about the product’s actual characteristics. AI-generated model depictions, demonstrations of product effects, and scene visualizations must not be used for false or misleading commercial promotion.

4. Labels for AI-Generated or AI-Synthesized Content

Depending on applicable laws and regulations, mandatory national standards, and the relevant feature and use case, we may add the following to AI Output:

(1) Visible labels (“explicit labels”), presented as text, graphics, or other forms that users can readily perceive, such as “AI-generated” or “Content generated by AI”; and

(2) Labels that are not readily perceptible to users (“implicit labels”), added through technical means such as file metadata or digital watermarks.

The labeling methods, placement, and appearance are those displayed on the relevant LazzaStudio feature pages, labeling settings pages, and in the AI Output.

You must not maliciously remove, alter, forge, or conceal any labels added to AI-generated or AI-synthesized content as required by law. You must not provide tools or services that enable others to engage in such conduct, or use false or improper labels to harm the lawful rights or interests of others.

Where permitted by applicable laws and regulations and supported by the relevant feature, you may actively request AI Output without explicit AI labels by following the instructions on the relevant page. You acknowledge and agree that the absence of an explicit AI label does not change the nature of the content as AI-generated or AI-synthesized content. The relevant files may still retain implicit labels, such as file metadata or digital watermarks, as required by law. When you subsequently publish or distribute such content, you must still comply with any applicable legal requirements to disclose and label its AI-generated or AI-synthesized nature.

5. Enforcement and Feedback

If we discover or have reasonable grounds to believe that your AI Input, content generation activities, or AI Output violates applicable laws or regulations, this Notice, other applicable rules, or the lawful rights or interests of third parties, we may take necessary measures in accordance with applicable law and the applicable terms. These measures may include refusing to process AI Input, stopping content generation, removing the relevant content, restricting access to certain features, or suspending the Services.
